1. APPLICATION OF TERMS AND CONDITIONS

By placing an order either via the internet, over the telephone or by post you agree to accept these terms and conditions. No other terms and conditions will apply unless agreed by us in writing.

2. ORDERS

Products will be embroidered as per your order. It is your responsibility to double check that the colours and any embroidery requirements are correct on your order. Carriage within the UK only is included in the price. Carriage outside the UK by separate quote. All orders subject to availability. We will acknowledge your order within 3 working days. Our order line is open Monday – Friday from 10.30am to 4.30pm.

3. DESCRIPTION & QUALITY

The quantity and description of the goods will be as set out in our acknowledgement of your order. Please check this carefully to ensure the colours ordered are correct, changes made after the product has been embroidered will incur a charge. Every care is taken to ensure consistency in the products as shown. However due to the handmade nature of our products there may be slight variations.

4. PRICE & PAYMENT

The price of the goods will be the price set out in our current catalogue at the date of order, unless we agree otherwise in writing. All prices are inclusive of VAT and postage within the UK only. For overseas orders please contact us for a quote. We reserve the right to alter prices either up or down including any variations in the rate of VAT. You will be notified of any such changes when placing your order. Gift wrapping is available at an extra charge Goods will ONLY be processed on full payment of cleared funds. All internet payments via PayPal. We accept all major credit and debit cards for telephone orders. Cheques and postal orders, for orders made by post, should be made payable to Winning Colours.

5. DELIVERY & RETURNS

We aim to dispatch items within 28 days of cleared payment and deliver within working hours. Footstools may take a little longer and you should allow 6 weeks. If you need a product sooner than this then please contact us and where possible we will oblige. We cannot guarantee time of delivery. You may be required to sign for delivery. Our terms, conditions and guarantees do not apply once the goods have been removed from the UK. We are not responsible for any import tax or duty on goods delivered outside the UK mainland. In the rare event that goods are delivered faulty or damaged please contact us upon receipt (within 24 hours) Any goods found to be faulty or damaged will be repaired or replaced. Due to the personalised nature of our products no returns will be accepted or refunds made, once the product has been embroidered, as per your acknowledged order.

6. RISK & TITLE

You accept responsibility for the goods from delivery You will own the goods once full cleared payment is confirmed.

7. LIMITATION OF LIABILITY

Our only liability to you under these terms and conditions will be:- i) to make good any shortage or non delivery or ii) to replace or repair our goods which are received in a damaged or defective state. We will not be responsible for goods that differ slightly from our photographed samples. Our liability for breach of contract is limited to the purchase price of your order.

8. FORCE MAJEURE

If for any reason beyond our control we are unable to deliver your goods we will notify you and defer the date of delivery.

9. JURISDICTION

This contract is governed by the laws of England and Wales. Any dispute must be referred to the courts of England and Wales.
